Wage Claim in California

The majority of employers are honest and fair. However, there are a few that don’t play by the rules and avoid paying their employees. Sometimes they may make a partial payment, but when you are hired to do a job and do the work, then you should get FULL compensation for it.

California Labor Laws take wage claims very seriously. California strictly requires that all employees are to be paid. The paycheck laws of the state leave very little, if any, wiggle room for the employer who is trying to avoid paying an employee what they are owed.

Do You Have An Unpaid Wage Claim in California?

Unfortunately, many people will walk away and take the loss because they don’t know that they are protected under the labor laws for unpaid wages in California. They either assume or were misinformed that they are not eligible for filing an unpaid wage claim. That couldn’t be further from the truth.

If you work in California and have an unpaid wage claim, you have a legal right to pursue your claim. Get the compensation you deserve.

Wage Theft

Wage theft happens whenever workers don't receive the wages they legally deserve for their work performed. This can include various situations, like paying less than minimum wage, not providing overtime pay for those who work over 40 hours a week, or having employees work "off the clock" before or after their shifts.

What does wage theft look like?

Even small amounts of time can have a large impact. Imagine a minimum wage worker earning the federal minimum wage of $7.25 an hour who works just 15 minutes “off the clock” before and after their shift every day. That extra 30-minutes of unpaid work each day represents a loss of about $1,400 per year, plus any overtime that should have been paid.

Who's protected?

California employment laws protect the undocumented worker the same way they protect the employee who is a legal US citizen. These workers' rights laws protect the independent contractor, temporary employee, or seasonal worker the same way they protect the full-time company employee.

California Overtime Law

We've heard it hundreds of times, "My employer owes me overtime pay." You have the right to be paid what you are owed.

California Overtime Law pertains to the rules governing extra pay for eligible employees who work more than a certain number of hours in a day or week. Overtime rules mandate that nonexempt workers (including domestic workers) get paid 1.5 times their regular rate for hours surpassing 8 in a day or 40 in a week.

If you believe your employer owes you overtime pay, it's important to take action. Review your work hours, pay stubs, and employment contract to gather evidence. If you're sure you're owed overtime, you could consider discussing the matter with your employer or HR department.

If the issue remains unresolved, seek LFECR's legal advice.

How Long Can an Employer Not Pay You in California?

Under the state’s wage laws, California employers have a legal obligation to pay wages to their employees when the wages are due. This includes regular paydays, overtime work, and the final paycheck.

Employees are typically paid every two weeks or twice a month but sometimes they are paid weekly or even daily. It all depends on what the employment arrangement requires. The official pay date is indeed the date that the employer is required to pay their employees.

Wages that are not paid on time cause a great deal of trouble for the employee who depends on that paycheck. The law takes into consideration not only that when a person is hired by someone and does the assigned work they should be paid, but it also looks at the potential loss and damages the employee could suffer if the employer fails to pay them on time.

Because of that, if an employer does not pay their employees on time, they could face stiff penalties and the employees could have a right to take legal action and recoup damages.
