Overtime Violations
Wage & Hour

Definition

In California, most employees must be paid 1.5x their regular rate for hours worked over 8 in a day or 40 in a week, and 2x their regular rate for any hours over 12 in a single day. California's daily overtime rule is stricter than federal law. Employers who deny these payments - including by misclassifying workers as exempt - are breaking the law.

Frequently Asked Questions

California overtime is based on both daily and weekly hours. You're owed 1.5x your regular rate for hours over 8 in a day or 40 in a week, and 2x your regular rate for hours over 12 in a single day.

No. A job title alone doesn't make you exempt from overtime. Exemption depends on your actual job duties and salary meeting strict legal tests - simply being called a "manager" doesn't satisfy those requirements.
